Plaintiff had been in the apartment for two hours before she heard banging on the door and P.O.s yelling for the door to be opened. Upon opening the door, P.O.s, including Emilio Melendez and Joshua Healy, pushed their way in, pushing her back to the wall. Officer Emilio Melendez grabbed and turned her around and pushed her stomach against a rail, causing her pain. Plaintiff told Officer Melendez that he was hurting her and that she was two months pregnant. Shortly after being pushed into the wall and rail, Plaintiff had vaginal bleeding. \n\nP.O.s searched the entire apartment and found a gun outside the premises on the fire escape. Though Plaintiff’s boyfriend took full responsibility for possession of the gun, Plaintiff was arrested and taken to the precinct. Plaintiff asked for medical attention but the nurse that examined her only gave her water and some pads for the vaginal bleeding. Unable to make bail, Plaintiff was sent to Rikers Island where she was seen by a doctor and told nothing was wrong. Plaintiff was then taken to a dorm. The next morning, Plaintiff miscarried while in the shower. Though she informed the officers, no one called for an emergency. Plaintiff was allowed to seek medical attention only later, as she was still bleeding and experiencing substantial pain.
