Defendant 1 used excessive force to try and handcuff the Plaintiff. He repeatedly and brutally struck Nacmias in his\nface, head, and upper body with a hard object, believed to be either or both, Defendant 1's firearm and/or metal handcuffs. He also forcefully pushed him before returning to his vehicle.  Nacmias suffered a severe gash to his mouth, swelling, bruising bleeding and contusions to the face and head, an injured shoulder, and pain, as well as emotional distress as a result of Defendant 1's actions. \n\nThe Plaintiff's called 911 then followed Defendant 1 as he drove off dangerously, recklessly and unlawfully.  Defendant 1 was arrested and found guilty. \n\nJohn and Jane Doe (\"Defendants 1-5\")  supervised Defendant 1, and knew\nor should have known of his violent propensities and failed to properly monitor, train, supervise, reprimand and/or discipline him\n\nCity of NY (\"Defendant 3\") was aware of the insufficient training Defendant 1 may have received. They were also aware Defendant 1 lacked the objectivity, temperament, maturity, discretion, and disposition to be employed as a police officer.
