One of the defendant officers aimed his weapon at Phillip Doyley and shouted for him to get on the floor, and Phillip Doyley obeyed the officer's instruction. Latoya was awakened by all of the commotion and was ordered to get on the floor as well, which she complied with and both Phillip and Latoya Doyley were placed under arrest. While both Latoya and Phillip were handcuffed, one of the officers asked if Andrew Doyley was present at the residence and Phillip answered in the negative then asked for a warrant. Officer Agosto refused to present a warrant at that time however he stated that he would show the warrant at a later time. The defendant officers and Phillip went back-and-forth about Andrew's whereabouts to no avail. The defendant officers searched Andrews room, then demanded that Phillip call Andrew and request he come home, and Phillip called Andrew. Phillip was able to reach Andrew and told him to come home, after which the officers took the handcuffed Phillip outside of the residence and Latoya remained in the home. Phillip was then placed in a van and driven three blocks away by PO Khan. Andrew did not arrive for sometime so the Officers ordered Phillip to continue to call his son and give a false story to entice him to come home. After nine phone calls in a two and a half hour period, Andrew finaly returned home and was placed under arrest. Once Andrew was placed under arrest, Phillip and Latoya had their handcuffs removed. The officers then requested Phillip and Latoya sign the warrant, which both refused to do until the officers threatened to call ACS to take their other children away. Thompson was parked in his wife's Honda minivan, when Defendant Police Officers Edward A. Washa and Adrian J. Ramos approached him. They identified themselves as police officers and then immediately asked the Plaintiff \"where's the weed at?\" Plaintiff replied that he didn't have weed and didn't smoke weed. The Defendants then pulled the Plaintiff out of the car and searched his vehicle. Plaintiff complied with the Defendants' demands and furnished his identification. After examining the identification and searching the vehicle, the Defendants placed the Plaintiff in handcuffs. Plaintiff asked why he was being arrested, but the Defendants ignored him and searched him, not finding any contraband on his person or in the vehicle. \n\nThe Defendants placed him in the back of the police van and took him to the 40th Precinct in Bronx, New York where he was held for approximately 35 minutes and verbally berated by the Defendant Officers and other unknown officers. The Defendants falsely claimed that they had found \"drugs\" in his vehicle. Plaintiff was then put back into the car by Defendants and driven around for three to four hours while the Defendants tried to make other arrests. Defendants then brought the Plaintiff back to the 40th Precinct where they parked the van and left the Plaintiff sitting in the back for an additional twenty minutes. Plaintiff was then taken to the 41st Precinct where he was processed, fingerprinted, and searched. As Plaintiff was being escorted out, he was recalled to be processed, fingerprinted, and searched again; after which he was taken back to the 40th Precinct. There he was interrogated by Defendants John Doe 1 and John Doe 2 who verbally berated him and then after twenty minutes he was taken to Central Booking where he was charged with Criminal Sale of a Controlled Substance in the 3rd Degree, Criminal Possession of a Controlled Substance in the 3rd Degree, and Criminal Possession of a Controlled Substance in the 7th Degree. Plaintiff was arraigned and bail was set at $1500.00. Plaintiff returned to Court on April 23, 2013 for felony arraignment  and the Prosecution dropped all the felony charges and offered an ACD. Plaintiff did not accept the ACD and the case continued as a misdemeanor action. Instead, PO Washa, Ortiz, Colon, and Jane Doe provided additional false allegations to back up PO Melendez's claims and filed false paperwork memorializing the false allegations against Plaintiff.
