On September 17, 2014, Plaintiff had participated in a protest against the firing of a public school principal outside of the school. On September 22, 2014, Superintendent Joyce Stallings-Harte had filed a false report with the Office of Special Investigations (OSI) claiming Plaintiff abused DOE time and harassed the Superintendent during the demonstration. On January 21, 2015, OSI found the Superintendent's claims to be unsubstantiated. Plaintiff received OSI's report on September 9, 2015. Plaintiff emailed the Superintendent on September 10 seeking an apology and again on September 17 notifying the Superintendent that Plaintiff intended to file complaints about the false allegations. The Superintendent subsequently filed the report with the police falsely stating that Plaintiff had sent three threatening emails between January and September 2015.\n\nPlaintiff turned himself in on September 23, 2015 and was arrested and charged with aggravated harassment. He was transferred to Central Booking and then released, being told in sum and substance \"You are being released.
