Defendant Police Officers including Muhammad Iyaz, Torab Chowdhury, and John/Jane Does approached Plaintiff and asked for his identification and Plaintiff was fearful of becoming a victim of police misconduct so he pulled out his cellphone and began recording Defendant officers.  Immediately after, once of the defendant officer's grabbed Plaintiff by his right hand and wrist, another officer took the Plaintiff's phone out of his hand.  Officers then threw the Plaintiff against the wall and handcuffed him causing him physical injury.  Plaintiff was then brought to PSA9 where he was searched, photographed, fingerprinted and placed in a holding cell before being brought to Queens Central for booking where he was subjected to another search and photographed. While Plaintiff was at Central Booking, defendant Officers, on information and belief, spoke to prosecutors in the Queens District Attorney’s Office Early Case Assessment Bureau and provided false information alleging Plaintiff was engaged in criminal conduct.  Defendant Officer Chowdhury signed a criminal complaint on December 15, 2018, which included statements from Officer Iyaz, alleging Plaintiff committed numerous felony and misdemeanor offenses including assaulting an officer and obstructing governmental administration. The arraigning Court Judge of the Queens District Attorney’s Office, set bail for the Plaintiff which he was unable to post.  Plaintiff spent 4 days in jail before we was able to have someone post on his behalf after which he was released.  Plaintiff went to PSA9 to retrieve his property but his phone was never returned to him.  Plaintiff also sought medical treatment for his wrist and was diagnosed with a fractured wrist which required him to seek further and continued medical treatment from an area hospital. Plaintiff had numerous court dates between his release and the disposition.
