As Plaintiff and his friend were discussing the fare with the cab drive, POs John Zorrilla and Laguna suddenly pulled alongside the cab and belligerently yelled at the driver to move the cab. Plaintiff, his friend, and a family member attempted to explain the delay but PO Zorrilla called the family member \"a fucking African.\" When Plaintiff protested PO Zorrilla's language PO Zorilla maced Plaintiff without warning, causing pain, burning, and a scratched cornea. Plaintiff left to go to a bodega to flush his eyes and PO Zorrilla never filed a complaint indicating Plaintiff had committed a crime during this incident. \n\nLater that same day Plaintiff and a family member went to the 42nd Precinct to make a complaint against PO Zorrilla. They were informed PO Zorilla was assigned to PSA 7, so Plaintiff and his family member decided to go the next day. When Plaintiff woke up the next day his eyes were red, burning, and itchy, and the vision in Plaintiff's right eye was blurry. Plaintiff went to the hospital, where he was diagnosed with a scratched cornea. At approximately 10:00 p.m. that day Plaintiff and his family member went to PSA 7 to file a complaint against PO Zorrilla. PO Zorrilla was present at the station and upon learning that Plaintiff wanted to file a complaint against him, PO Zorrilla retaliated by handcuffing and arresting Plaintiff without legal justification. \n\nPlaintiff was falsely charged with disorderly conduct in order to cover up PO Zorrilla's unlawful actions, and Lt. Neil Zuber unlawfully approved Plaintiff's arrest. Plaintiff was detained in PSA 7, where he required medical attention for vomiting and eye pain due to the macing. PO Zorrilla initiated a malicious prosecution against Plaintiff, but the District Attorney's office declined to prosecute because Plaintiff's conduct did not support the charge. Plaintiff was released on November 23, 2015 after approximately 24 hours in custody. Plaintiff filed a formal complaint with the CCRB and IAB against PO Zorrilla and Lt. Zuber. The CCRB substantiated Plaintiff's complaints against PO Zorrilla and Lt. Zuber and both officers were disciplined.
