She saw a large group of teenage girls arguing. Even though neither Plaintiff nor her friends were involved in any argument or fight, several of the officers, including Individual Defendants, surrounded Plaintiff and pulled her down by her hair, actually pulling her hair out of her scalp. She was violently brought to the ground, where she was handcuffed behind her back. Plaintiff was forcibly picked up off the ground and placed against a parked car. She was then placed in a police car and driven to a police precinct. Defendants Officer McNulty and Lieutenant Holley failed to intervene in this assault and arrest. Plaintiff remained in police custody for nearly two days before she was arraigned on a Misdemeanor Complaint filed and released on her own recognizance. The Misdemeanor Complaint was sworn out by Defendant Officer McNulty, who falsely stated that Plaintiff refused to leave the location, fought, yelled, and screamed, causing a public disturbance and inconvenience. Plaintiff was told police had just beat up and were arresting her niece (Tiana Damon) and Tiana's friends. Plaintiff ran back to see what was happening and asked officers what was going on when she arrived. Several officers then grabbed Plaintiff, aggressively pushed her against a van, handcuffed her and placed her into a police car. Defendant officers also pulled at and pulled out Plaintiff's hair and violently brought her to the ground. Defendant Officer McNulty and Lieutenant Holley observed all of this but did nothing. Plaintiff was driven to the police precinct and remained in custody until her arraignment after midnight the following day. As a result of her detention, Plaintiff missed her 11-year-old daughter's birthday and party. The misdemeanor complaint against Plaintiff stated Officer McNulty observed Plaintiff stand between Lieutenant Holley and Tiana and her friends in an attempt to prevent Lieutenant Holley from handcuffing Tiana and her friends. Officer McNulty also states she was informed by Officer Barrientos that when placing Plaintiff under arrest, Plaintiff flailed her arms and kicked her legs. Plaintiff denies all such claims.
