Defendant Johnson threw Plaintiff Diaz to the ground, assaulted him, and cuffed him.  Defendants Taveras and Guzman were similarly pulled from the vehicle and arrested by other officers.  All of the Plaintiffs were taken to the 46th Precinct.  There Diaz was strip searched, after which he lost consciousness.  He was taken for medical treatment and diagnosed with a concussion from Defendant Officer Johnson’s excessive and unprovoked assault.  Defendant Guzman was taken to central booking and released after appearing before a judge.  Defendant Taveras was taken to central booking and released without appearing before a judge.  All charges (unspecified) against Defendants Guzman and Taveras were dismissed on February 8, 2012.   Charges were filed against Defendant Diaz for assault, harassment and driving under the influence.  Those charges against Defendant Diaz were still pending.
