The Defendant officers, including P.O. Everett, P.O. Morales, and John or Jane Doe 1-10, approached the Plaintiff and the aforesaid driver, and attempted to intimidate the Plaintiff into paying the aforesaid driver. The Defendant officers unlawfully targeted the Plaintiff due to his race/ethnicity. Despite the Plaintiff explaining that he did not bump the vehicle, that he would prefer to deal with the purported accident claim through insurance and that he did not have the full sum of the money demanded by the other driver, the Defendant officers asked the Plaintiff for his license, falsely accused the Plaintiff of Driving While Intoxicated, and demanded the Plaintiff to take a breathalyzer test despite no indication that the Plaintiff was intoxicated. The Defendant officers then unlawfully searched the Plaintiff, grabbed and violently contorted the Plaintiff’s arms behind his back and applied handcuffs to his wrists in an excessively tight fashion without probable cause. The Defendant officers falsely accused the Plaintiff of Operating a Motor Vehicle while Intoxicated and Operating a Motor Vehicle while Impaired by Alcohol. At the time, the Plaintiff was not intoxicated by alcohol or any substance, and exhibited no signs or indication whatsoever of intoxication. The Plaintiff was transported to the 30th Precinct, and later transferred to County Central Booking. The Defendant officers fabricated evidence to the DAs office, claiming that the Defendant officers found stolen property in the Plaintiff’s possession, and initiated a malicious prosecution against the Plaintiff.
