After a short while, the unknown black car, later discovered as an unmarked NYPD vehicle, crashed into Plaintiff’s car, totaling it as well as injuring Plaintiff’s back and fracturing his chest bone: sternum. The car crash caused Plaintiff’s car hit a parked car. Bystanders begin to fled the area on foot and the Plaintiff follows the bystanders and begin to run from the scene, fearing that the unknown individuals from that unmarked black car might cause further harm. However, the plaintiff was tackled from behind by a group of individuals. Only at this point did the plaintiff realized that he was pursued by police officers.\nThe police officers arrested the plaintiff, punched, kicked, tased, and hit the plaintiff’s head with a blunt metal object as the plaintiff lay motionless on the ground. Plaintiff did not resist arrest. No illegal contraband from the Plaintiff was found, nor did the officer accused him of any crime or wrongdoing. The plaintiff was tightly handcuffed to the precinct. The officers then struck plaintiff in the head, body and limbs, causing injury. Officers placed their knees on the plaintiff's body and ground the plaintiff's face and body into the street. PO defendants handcuffed the plaintiff, and bent his body in half, attempting to bring his feet towards the back of his head. Plaintiff was unlawfully arrested and taken to the 42nd Precinct in his underpants since his pants having fallen down his body during the assault, causing him further embarrassment. Plaintiff was thereafter transported to PSA-7 where he fell sick to the floor inside a holding cell. As a result of the defendant’s assault, plaintiff fell ill and was transported from the precinct to the Bronx Lebanon Hospital ER where he was treated and released and then transported back to PSA-7 shackles handcuffed. While plaintiff was in the custody of the defendants, defendants prepared and filed false paperwork against plaintiff. At plaintiff’s arraignment, the judge imposed $75,000 bail based on the officer’s false paperwork, which plaintiff could not afford. As a result, the plaintiff was unlawfully imprisoned until approximately August 17, 2021.
