Plaintiff was hired by three individuals to drive them for the day, and made several stops. Plaintiff was driving his vehicle when he was rear ended by another vehicle, which attempted to flee the scene. Plaintiff drove in the same direction until he had to stop for traffic, when his passengers suddenly exited the vehicle. Plaintiff could not see what they were doing until they returned and directed him to make a u-turn. NYPD Officers Jonathan Katz, Alexis Soto, Muhammad Abuhaikal, and Carlos Rivera saw the u-turn and began to follow Plaintiff's vehicle. The Officers were flagged down by the hit and run driver who told the Officers three man had attempted to carjack them. The Officers cut off Plaintiff's van and approached the vehicle with their guns drawn. They ordered Plaintiff and his passengers to exit the vehicle and immediately arrested them. The victim identified Plaintiff's passengers as being involved in the alleged robbery, but not Plaintiff. Defendant Officers searched Plaintiff's vehicle and determined he was a licensed taxi driver. \nPlaintiff was then taken to the precinct, where Plaintiff's passengers informed Defendant Officers that Plaintiff was innocent, and Plaintiff also informed the Officers that he was innocent. Regardless, Defendant Soto falsely informed investigating Detective Annette Francesquini that she had observed Plaintiff pointing a knife at the victim, which Soto later admitted at trial was false. Detective Francesquini knew or should have known this was false because it was not corroborated by the other Defendants, the victim, or any other witnesses. Plaintiff was arraigned and released on his own recognizance. After a mistrial and second trial, Plaintiff was convicted of robbery and served a sentence of three and a half years of imprisonment and two and half years of post-release supervision, which he completed.
