Plaintiff Russo answered the door and Defendant John Doe 1 showed her a photograph and asked if she knew the person in the photo. Plaintiff Russo informed the Defendant that she knew who it was and called for Plaintiff Sottile. Plaintiff Sotille came to the door and the Defendants instructed the Plaintiffs to exit and house and go to the backyard, and the Plaintiffs complied. The Defendants then showed Plaintiff Sotille a picture of her then-boyfriend and questioned her about his whereabouts while threatening to arrest her if she did not provide answers. While this was happening, more Defendants arrived at the house and informed the Plaintiffs that they had to enter the home, but Plaintiff Russo's son, who lived in the house with his mother and sister, informed the Defendants that they did not have permission to enter the home. The Defendants entered the home without permission and searched it for approximately twenty minutes, and then left with Plaintiff Sotille's then-boyfriend in handcuffs. After placing Plaintiff Sotille's then-boyfriend in a NYPD vehicle, Defendant Garsing Chan, without justification or legal cause, pushed Plaintiff Russo onto the concrete, where she banged her head and lost consciousness. Defendant Chan then dragged her against the concrete toward the vehicle. At almost the same time as the assault on Plaintiff Russo, Defendant Leonardo Viera, without justification or cause, tackled Plaintiff Sotille, and upon information and belief, Defendant Chan pushed Plaintiff Sotille's face while Defendant Viera held her. The Defendants then threw Plaintiff Sotille to the ground, and upon information and belief, Defendant Viera placed his knee on her back without cause. The Defendants then rear-handcuffed both Plaintiffs and imprisoned them in separate NYPD vehicles.\n\nAs the Defendants transported Plaintiff Sotille to the NYPD's 63rd Precinct, she complained that she was having an asthma attack and begged them to stop. But the Defendants would not let her retrieve her inhaler, which was in her house. They told her to wait until they arrived at the precinct, but on the way they saw an ambulance parked on the street and they pulled over. An emergency medical technician administered oxygen to Plaintiff Sotille. After a few minutes they transported her to the 63rd Precinct where she remained imprisoned; Plaintiff Russo was also transported to the Precinct. Eventually the Plaintiffs were transported to the Brooklyn Detention Complex, where they were imprisoned until they were brought to the Kings County Criminal Court for arraignment. Both Plaintiffs were arraigned on September 3, 2013 on the false charges made by Defendant Viera. The presiding Criminal Court judge released the Plaintiffs on their own recognizance.
