Defendant officers, on scene responding to a robbery call, stopped the group including plaintiff. The complaining witness of the robbery was intoxicated with impaired judgment. When officers asked complaining witness to identify anyone from the group of 20 people stopped, complaining witness identified plaintiff and another male from the group as the suspected perpetrators. Plaintiff and the other male were arrested and taken to the 44th precinct. Defendants failed to conduct a proper lineup. Plaintiff was arraigned in Bronx Criminal Court, based on a accusatory instrument signed by defendant Ackerman containing false allegations. Plaintiff was detained in Rikers Island for about 150 days. On August 27, 2012, plaintiff was released when he was able to post bail.
