Overall, plaintiff was detained for approximately 10 hours and maliciously prosecuted until all criminal charges against him were dismissed and sealed. \n\nDefendants engaged in fraud, the suppression of evidence, perjury, gross deviation from acceptable police conduct, and other conduct undertaken in bad faith, including the withholding of other video surveillance recordings and witness statements or accounts, which all directly contradict the false allegations. As Plaintiff and Hines were waiting at a red light, an unknown vehicle pulled up next Plaintiff and Hines’ car, and someone inside the unknown vehicle began firing a gun into Plaintiff and Hines’ car. Hines immediately sped away, and Plaintiff felt a pain in his hip. Unknown if he was shot, or how badly he was injured, Hines began to drive Plaintiff to Brookdale University Hospital. However, their vehicle was soon pulled over by Defendants Police Officers in a marked patrol car. When Defendants Police Officers approached Plaintiff and Hines’ vehicle, officers ordered Plaintiff and Hines to step out of the car. Plaintiff explained the situation to Defendants Police Officers before Defendants detained Plaintiff and Hines roadside. Defendant officers determined an outstanding warrant existed for Hines, and Plaintiff volunteered to go to the 69th Precinct to accompany his friend, with the expectation that Hines would be released and would then take Plaintiff to the hospital. Defendant Police Officers searched the vehicle without consent by Plaintiff Clifton or Terique Hines. Plaintiff did not observe defendant officers remove any items of contraband from the vehicle, and Plaintiff was not informed that any contraband was recovered from the vehicle. Despite the fact that Plaintiff was not operating the motor vehicle, had committed no infractions, had no outstanding warrants, was not under arrest for any charges, and was still in pain from a gun-related injury, Plaintiff was handcuffed to bench inside the confines of the 69th Precinct and questioned by defendant officers about his ties to any criminal related activity, and told he had to wait to speak to another Detective. Although Plaintiff had not been told he was\nformally under arrest, or was suspected of violating any law, he was handcuffed and placed in a locked cell for hours. Despite having complained of a shooting relating injury and requesting medical attention, Defendant Police Officers delayed for an extensive period of time before calling an ambulance to the precinct to transport him to the hospital. Despite not being charged or informed of his arrest, defendant officers shackled Plaintiff’s hands and feet inside of the ambulance. After examination at the hospital, defendant officers falsely arrested Plaintiff, who was transported to the 69th precinct and then transferred to Brooklyn Central Booking. While Plaintiff was incarcerated, Defendants falsely and maliciously told the Kings County District Attorney’s Office that Plaintiff had committed numerous crimes, including Criminal Possession of Weapon and Possession of a Forged Instrument. Based on the defendant’s false statements, the Kings County District Attorney’s office chose to prosecute Plaintiff under docket CR-028556-19KN. Throughout the year 2017 and 2018, the NYPD began a concerted effort to enforce their will upon PawnRite often by randomly investigating crime leads and forcing the business, under threat of heavy-handed tactics, to comply with their demands. It is well known throughout the industry that the NYPD had been promoting a policy which coerced pawnbrokers to submit to warrantless intrusions for purposes of undertaking criminal investigations , under the guise of conducting an administrative inspection scheme. Whenever Pawn Rite resisted these intrusions, the NYPD\nresponded with threats of follow-up visits to their various branches while demanding “compliance” with their “inspection program”. During these visits, the NYPD issued warnings which included maintaining a heavy police presence at their branches, arrests, store closure and issuance of criminal/administrative code violations. On April 3, 2018, NYPD officers conducted an “undercover sting operation” at 8215 Flatlands Avenue, Brooklyn (the “Flatlands branch”). Undercover Police Officer Defendant Mario  Natalie entered the Pawn Rite Flatlands branch and posing as a customer approached Plaintiff Rodriguez to undertake a transaction. After negotiating terms with Rodriguez, Defendant Natale consummated a legitimate transaction with Pawn Rite having sold a certain electronic device, signing a contract while collecting the agreed compensation (from Rodriguez).\nDefendant Natale notably provided proper identification and affirmed that he had the right to sell the bespoken merchandise. Nonetheless, Rodriguez, was subsequently arrested without any justification or probable cause. The arrest was undertaken by Defendant Jonathan Taveras and was apparently engineered by the command of NYPD Precinct 69 - one particular precinct which had previously been intruding on Pawn Rite and threatening reprisal for their failure to “comply”. Defendants falsely claimed through a criminal accusatory that the merchandise they sold to Rodriguez/ Pawn Rite had been openly discussed as being “stolen”. Rodriguez was incarcerated and charged with possession of stolen property and was compelled to appear on numerous occasions before the Kings County Criminal Court. All charges against Rodriguez were dismissed. Plaintiff was then pushed against his car and patted down and was arrested and taken to the 73rd precinct. All charges against Plaintiff were dismissed. The third incident occurred when Plaintiff had stopped in front of his friend's house to drop her off. An unmarked police vehicle pulled up behind Plaintiff's car and  then Defendant Officer forcefully grabbed Plaintiff out of the vehicle. Plaintiff's female friend was recording the incident with her phone when Defendant Officer told her she had to delete the video otherwise Plaintiff would be taken into custody. Plaintiff was handcuffed and arrested and one of the Defendant Officers kicked Plaintiff in the leg causing him to fall. Plaintiff was taken to the 73rd Precinct and later a hospital. Plaintiff was charged with marijuana possession, possession of a weapon, and a warrant charge.
