As plaintiff and his mother exited the building through the lobby, defendants approached, stopped, questioned, frisked, and searched plaintiff. Plaintiff was handcuffed. Defendants slammed plaintiff to the ground while handcuffed and stepped on plaintiff. While on the ground, defendants pepper sprayed plaintiff. Plaintiff was transported to the 50th Precinct. Plaintiff asked for medical attention for severe pain in his eyes and back. EMS responded and determined plaintiff’s injuries required hospital treatment. Plaintiff was transported to Bronx North Central Hospital. After treatment, plaintiff was transported back to the 50th Precinct where he was photographed, fingerprinted and placed in a holding cell. Defendants strip-searched plaintiff. After 24 hours, plaintiff was transported to Bronx Central Booking and placed in a holding cell. Defendants provided the DA with false information which lead to prosecution against plaintiff. After being detained for 32 hours, plaintiff was arraigned in Bronx Criminal Court and charged with Obstruction of Govt Administration and Resisting Arrest. Plaintiff appeared in Court on numerous occasions.
