An individual who emerged from a car parked right in front of the plaintiffs fired several shots, and Plaintiff Boston quickly drove away. In the process of leaving, his car side-swiped a Toyota sedan double parked on the block. Shortly after leaving, the Plaintiffs returned to try to take responsibility for damaging the car. When they returned, officers were investigating the shooting and were questioning bystanders about who owned a white BMW. Plaintiff Boston identified himself as the owner of the vehicle. The Plaintiffs provided their identification and consented to allow the officers search Boston’s car. After completing the search, the officers were prepared to let the Plaintiffs go, but then other officers, including Detective McDonald, arrived and arrested the Plaintiffs. The Plaintiffs were arrested based on the questioning of the driver of the damaged Toyota, who claimed to have seen Boston lean out of the vehicle and fire a gun while Plaintiff King was operating the vehicle, before the BMW swiped the Toyota in an attempt to flee. Officer Boutari charged the Plaintiffs with felony criminal possession of a weapon in the second and third degree, felony reckless endangerment in the first and second degrees, and other criminal charges. \n\nA notice stated that the driver of the Toyota positively identified the plaintiffs. However, the driver denies making such a statement. Other witnesses on the scene told the police the shooter emerged from a car with a hatchback and fired from the street, not from a vehicle. There were also numerous surveillance cameras in the area the officers could have checked. Nonetheless, the Plaintiffs were arrested, brought to the 81st precinct, and held for around 8 hours. They were then transported to Central Booking and held for an additional sixteen hours. They could not immediately pay bail and were thus transferred to Rikers’ Island, where Boston remained for three days and King remained for six days. King was released with no charges on the day the evidence was supposed to be presented to the Grand Jury.
