Wilkes had purchased eye drops from a nearby drug store for an eye injury sustained by chemical splashing in his eye while performing plumbing work inside a residence nearby. Wilkes was walking back towards the residence when he heard someone yell, \"Come here!\" Wilkes turned towards that direction and saw a gray-colored van with tinted windows. Unbeknownst to plaintiff, he van was occupied by Police Officer Jon Gladstone, Police Officer Omar Colon and Police Officer Andrew Duguid. Wilkes became scared and ran a shot distance. While running Wilkes saw a white male dressed in street clothes chasing him while pointing a firearm at him. The white male then,or the first time, identified himself as a police officer.  The officer yelled, in sum and substance, police, stop, put your hands up, turn around and lay down on the ground with your hands behind your back. To which Wilkes immediately stopped as directed and went to the ground, chest down. While Wilkes was lying on his chest and stomach the officer drive his knee into his back. The defendant officers then handcuffed Wilkes. Upon information and belief, the defendant officer stopped Wilkes based on an unlawful practice of stopping and searching individuals based on their race and/or nationality and not for a lawful particularized suspicion that Wilkes was committing a crime. The defendant officers then detained Wikles on the street for approximately 30 minutes. The then detained Wilkes in a prisoner van for 2-3 hours. Throughout the time Wilkes was detained Wilkes repeatedly asked for medical attention but his requests were ignored. The defendant officer then transported to the 81st precinct station house and placed him in a holding cell. Again, while Wilkes was in the holding cell he continued to ask for medical attention. Approximately, 7 hours later after Wilkes was arrested he was transported to Central Booking without medical attention. Finally, at Central Booking an unidentified individual examined Wilkes and indicated that Wilkes needed immediate medical attention. Wilkes was finally transported to Brooklynn Hospital Center via ambulance (but handcuffed while transported). Wilkes was discharged from the hospital at approximately 3:36pm on July 22, 2013 and thereafter arraigned on July 23, 2013 based on false allegation that Wilkes possessed marijuana and further resisted arrest.
