Minutes later, Erickson left. Defendant Undercover Officer 5058 (\"UC5058\") approached Plaintiff, grabbed him aggressively, placed him against the wall, patted him down, and searched him. Plaintiff sustained bruising from being aggressively grabbed and thrown during his arrest. No illegal substances or police marked money were found in Plaintiff's possession. Plaintiff was arrested, handcuffed, and crammed into a police van with six other men already in custody. They were brought to the 34th Precinct for processing, where Plaintiff repeatedly asked the Officers why they arrested him and none answered. Plaintiff spent approximately 24 hours in custody before arraignment. He was charged with several marijuana offenses and subject to prosecution from October 19, 2015 to March 29, 2016. On March 29, 2016, Plaintiff's case was dismissed pursuant to speedy trial provisions.\nOn January 9, 2016, Plaintiff was on his way to his aunt's residence when he saw a friend, Roselio Gomez, and stopped to talk to him across the street from the building where Plaintiff's aunt resided. Four unmarked police vehicles approached Plaintiff and Gomez. Police officers exited and approached Plaintiff. One of the officers aggressively grabbed Plaintiff's arm with a tight grip while another officer held Plaintiff in place. The officers patted down and searched Plaintiff, finding no illegal substances or police market money. The officers interrogated Plaintiff about a crime without advising him of his Miranda rights. Officer L. Maraj exited one of the vehicles and told the officers to arrest Plaintiff. Plaintiff recognized Maraj from a previous false arrest on May 12, 2015, for which Plaintiff brought a false arrest suit against the City of New York and Maraj in the federal court in the Southern District of New York. Plaintiff and the City settled the case for $37,000. The officers tightly handcuffed Plaintiff and took him to the 34th Precinct for processing. Plaintiff witnessed Maraj enter the Precinct and walk around the area where Plaintiff was held. Plaintiff called over Maraj, who responded by coming aggressively toward Plaintiff and standing excessively close to him. Plaintiff asked Maraj for his name and badge number, to which he responded only with his first name. Plaintiff asked why he was arrested but received no answer.
