Officer Wynne falsely broadcasted that Plaintiff was armed and involved in a murder, leading to the officers using excessive force. Plaintiff was physically restrained, assaulted, and his pre-existing shoulder injury was aggravated, resulting in a dislocation that required surgery. Despite knowing Plaintiff was unarmed, the officers detained him and ignored his pleas for medical attention. Plaintiff was further injured when Officer Louis Vannucci forcibly yanked his arm while he was handcuffed, exacerbating his injuries.\n\nThe complaint alleges that these officers acted based on false information generated by NYPD's Patternizr system, which inaccurately flagged the Plaintiff as a suspect in crimes, including murder. The officers used this false information as justification for their actions, leading to multiple arrests, extended detention, and further violations of Plaintiff's rights, including deprivation of necessary medical care. Defendant NYPD Sergeant Yuriy Akopov approached Plaintiff and ordered her to move from where she was standing on the sidewalk, but Plaintiff was unable to do so, as members of the NYPD had surrounded and kettled the counter-protestors. Defendant Akopov then pushed his hand into Plaintiff's chest, and when Plaintiff asked him not to do so, Defendant Akopov grabbed Plaintiff's right breast hard and squeezed forcefully. Plaintiff continued to ask Defendant Akopov to stop grabbing her breast, but he continued to grope her for several seconds before then pushing into her body and shoving past her, causing Plaintiff to fall backwards. Defendant NYPD Sergeant Soheil Sofizada and NYPD Member Jane Doe were next to Defendant AKopov for the duration of the incident but did not intervene. The man confronted the plaintiff and Plaintiff Bensabeur apologized.  As Bensabeur tried to leave, the man grabbed the Plaintiff and punched him in the back of the head; two other men joined in the assault and also began to attack Bensabeur.  Witnesses at the bar repeatedly told NYPD officers that Bensabeur had been assaulted and that the assailants ran away.  However, NYPD Officers Amet Vrzivoli and Aaliyah Card, as well as 8 Unidentified Officers arrested the Plaintiff and charged him with disorderly conduct and resisting arrest. Although Mr. Bensabeur did not resist arrest, he was assaulted by the Defendants during his arrest: the Defendant Officers hit Plaintiff multiple times, slammed him to the ground, put a knee in his back, loosened one tooth and knocked out one tooth.  On the day of his arrest, Mr. Bensabeur was taken to the hospital for the oral trauma and had a tooth extracted and received sixteen stiches inside his mouth and lip. Plaintiff Bensabeur was ROR'd at his arraignment, but was incarcerated for 19 hours.  He had to make 5 court appearances, missed work, and had to get dentures and implants.
