Plaintiff received a phone call from his tenant explaining that police officers had gone through a closed gate and entered the backyard. As plaintiff approached his property the officers, Stan Nova, Vasily Ignatov and other unnamed officers were in the front of his house. Plaintiff explained he was the landlord of the property and wished to enter. The officers told the plaintiff he was not allowed to enter, when he asked why the officers told him to \"shut up\". The plaintiff then asked why he wasn't allowed to speak and one of the defendant officers told the plaintiff that if he spoke he would be arrested. When the plaintiff asked again why, he was placed in handcuffs, put in a police vehicle and taken to the precinct. At the precinct Officer Nova and Ignatov falsely informed employees of the Kings County District Attorney's Office that they has observed the plaintiff committing crimes/ offenses. After spending approximately twenty-four (24) hours in custody plaintiff was arraigned and released.
