During the drive, Plaintiff 1 started to feel light-headed. He parked his car and then passed out in a diabetic coma. PO Polanco (at the time of the complaint, Plaintiff 1 believed “Polanco” to be the name of one of the NYPD officers who arrested him; he was not certain), PO John Doe 1, and potentially other police officers, approached Plaintiff’s car. While Plaintiff 1 was unconscious, and in front of his daughter, PO Polanco or another officer opened his car door, smashed his face against the window, and threw him to the street on his head. The officers then dragged him across the sidewalk, handcuffed him, drove him to a precinct house, and kept him locked in custody, handcuffed for hours, unconscious, and without any medical treatment for his diabetic coma. The handcuffs were so tight that they were causing excruciating pain. The officers kept Plaintiff 1’s family from knowing where he was or how he was, knowing they were terribly worried and they refused his wife’s, Plaintiff 2, repeated calls to get him the emergency medical treatment he needed.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.594561/gov.uscourts.nysd.594561.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/66862112/portorreal-v-new-york-city-police-department/"},{"name":"Martiz, Dorothea as Attny In Fact of Martiz, Joshua vs City of Ny, et al.","start_date":"2021-10-04","payout_amount":0,"disposition":"","docket":"158911/2021","court":"Supreme Court - New York","summary":"On August 21, 2020, at approximately 5:20 p.m., Plaintiff, while lawfully inside the building at 475 West 186 Street, was subject to an unlawful stop, question, frisk, search, false arrest, excessive force, and false imprisonment by the defendant Officers Oscar Polanco, Benjamin Paley and others (together the \"defendants\"). Plaintiff was there with his friend who lawfully resided in the building at the time and they were going to see the friend's father. Plaintiff suffered injuries to his body, face and to his wrists, as well as mental and emotional injury. When plaintiff entered the hallway before reaching the father's apartment he saw there were police and paramedics outside in the hallway. He therefore did not enter the apartment. The police told plaintiff and his friend to back up but they were in a narrow hallway surrounded by police and medics. As plaintiff tried to back out he was suddenly punched in the face and then tased by one of the defendants. He fell to the floor and was tightly handcuffed and then brought outside to an ambulance. Other officers who were present failed to intervene. At the time he had taser prongs stuck in him and was bleeding from the nose. He was brought to a nearby hospital. He was then taken to the 34th precinct and subsequently to central bookings. In total he spent about 48 hours in custody. Plaintiff was maliciouly prosecuted based on false allegations by the defendants. Plaintiff was subject to the negligent infliction of emotional distress.
