At no time did Plaintiff possess an open container of alcohol, nor did he possess a loaded weapon, or any other illegal objects. The officers arrested Plaintiff despite there being no evidence that he was in possession of such things. Plaintiff was transported to the 107 Precinct, where he was subjected to a strip search. On August 18, 2019, Plaintiff was arraigned in Queens County Criminal Court where he was charged with Criminal Possession of a Weapon in the Second Degree, Criminal Possession of Stolen Property in the Fourth Degree, and Consumption of Alcohol on Streets Prohibited.
