Defendant Police Officers Nicholas Virgilio and John Does #1-10 denied Plaintiff access to his medications, so Plaintiff began to feel dizzy and sick and requested his medications again. Instead, Defendant Police Officers Nicholas Virgilio and John Does #1-10 tasered Plaintiff, who fell backwards and slammed his head and face on the ground causing serious physical injuries. Then, Defendant Police Officers Nicholas Virgilio and John Does #1-10 hit Plaintiff with their night sticks and stomped on his left wrist, breaking it. Plaintiff was then transported to the hospital for medical treatment, where he also had the taser points removed. After 12 hours, Plaintiff was transported back to the 6th Precinct and then Central Booking, where upon being unable to post bail he was transported to Riker's Island. The arrest occurred after an incident at a bar, where after a misunderstanding regarding their orders, Orr and her friends were asked to leave. Immediately upon exiting, they were forcibly detained by the officers, subjected to an illegal search, and taken to the NYPD-6th Precinct. Orr experienced physical and verbal abuse, was inappropriately searched, and sustained injuries due to excessive force. Due to the incident and his injuries Plaintiff was forced to miss one week of work, and had to continue to seek medical treatment for the injuries inflicted on him by POs.
