A few moments later, about ten police vehicles suddenly appeared on the scene to investigate the alleged report of gunshots fired. Defendant Officers then approached Plaintiffs without legal justification and began questioning them about the incident. Defendant Officers Michael L. Balioni, Jiantong Li and Defendant Officers Jane and John Does then, absent any probable cause or reasonable suspicion, pushed both Plaintiffs and told them to back up. The moment the Defendant Officers arrived on the scene, they started to indiscriminately push innocent people around the area, causing many to fall to the ground, including Plaintiffs. Plaintiff Compere was struck in the face by a Jane Doe, slammed to the ground, and metal handcuffs were placed on their wrists. Plaintiff Haynes was slammed to the ground, metal handcuffs were placed on their wrists, and he was dragged to the police vehicle. While Defendants transported Plaintiffs to the 60th Precinct, Defendants refused Plaintiffs’ requests for medical attention.
