He documented the speech activity with video and still photography. At approximately 9:00 a.m., officers including Captain Mark Iocco arrested Mr. Gershkovich while he was standing outside a commercial building on the corner of Water and Broad Street. The officers singled out Mr. Gershkovich because he was an active participant in the Occupy Wall Street Movement.\n\nOn September 18, 2012, at 7:15 p.m., Captain Iocco falsely testified to a member of the New York County District Attorney's Office in order to maintain Mr. Gershkovich's detention. Captain Iocco falsely swore that he observed Mr. Gershkovich inside the building lobby with 30 other individuals, that he observed Mr. Gershkovich in the lobby yelling and screening, and that he told Mr. Gershkovich multiple times that he must leave the building or else be arrested for trespassing. \n\nNone of this was true and Captain Iocco knew that none of it was true at the time. What actually happened is that Mr. Gershkovich was taking photos of officers, such as Captain Iocco, making arrests inside of New York Plaza 4 and then exiting the building. Captain Iocco approached Mr. Gershkovich and asked him if he had a press pass. He responded that he did not need a press pass. Captain Iocco informed him that he was being arrested. P.O.s Ivan Bautista, Daniel Cross, and an unknown John Doe P.O. were all very nearby and could hear the entire interaction. Mr. Gershkovich turned around and put his hands behind his back. Captain Iocco aggressively grabbed at him, violently and aggressively pushed his face into a brick wall, and arrested him. He was held for approximately 40 hours before being arraigned. The plaintiff gave a presentation with a microphone to people in the park, and was approached by NYPD Captain Mark Iocco, who asked her if she had a permit for sound.  Plaintiff had been denied a permit for amplified sound earlier in the day.  Plaintiff alleges that there were large numbers of police at Zuccotti Park which constituted an attempt to intimidate, and plaintiff alleges such intent to intimidate is abuse of process. Though plaintiff attempted to cite first amendment case law which supported her right to demonstrate at the park, NYPD officers eventually arrested her, placing her in zip-lock ties. The zip lock ties exacerbated plaintiff's preexisting arthritis and caused her to cry in pain. All of her property, including cash, her plasma screen TV, a car battery, a projector, and other items were confiscated. The officers put her in a paddy wagon with no seatbelts. Police officer Kino Cox drove erratically. She was charged with a sound ordinance violation, an obstruction violation, and for refusing to move. Plaintiff alleges that she was arrested for being in Occupy Wall Street, not for noise. She was eventually brought to Bellevue Hospital, where she remained for 8-10 hours at least.  Also while detained, the plaintiff was thrown against the wall after she resisted being scanned with an iris scanner; at this point, the police put her in handcuffs, which exacerbated her arthriitis. Defendant Iocco grabbed plaintiff by the strap of his messenger bag and dragged him through a crowd of defendant officers. Defendants Bautista and Suddler placed plastic flex-cuffs tightly around plaintiff’s wrists, causing pain then numbness to plaintiff’s hands and wrists. Defendant was charged with disorderly conduct and released after 13 hours in custody.
