Clint Moody unlawfully arrested and handcuffed Plaintiff without legal justification. Plaintiff's ex-girlfriend had made a complaint against Plaintiff, alleging Plaintiff had violated an order of protection. However, Plaintiff's ex-girlfriend thereafter recanted her complaint and informed Det. Moody the incident did not occur. Regardless, Det. Moody arrested Plaintiff and transported Plaintiff to the 79th Precinct where he was criminally processed and detained. While detained Det. Moody falsely told the District Attorney's office that Plaintiff committed a crime, intentionally withholding the fact that Plaintiff's ex-girlfriend recanted her claims. \n\nAfter being detained for several hours Plaintiff asked to use the bathroom. As Plaintiff walked to use the restroom Det. Moody grabbed Plaintiff, threw him to the ground, and stomped on his right hand several times without provocation or justification. EMS responded and determined Plaintiff needed to be seen by a hospital. Plaintiff was transported to the hospital where he was diagnosed with contusion of the right hand. Plaintiff was returned to the 79th Precinct then Central Booking, where he was charged with Criminal Contempt in the Second Degree.
