Despite the Plaintiff's compliance, the officers yelled at him, battered, assaulted, and dragged him out of his car, falsely arresting him in an excessive manner. They applied excessively tight handcuffs, causing him extreme pain, and those officers present but not physically involved failed to intervene. After being transported to the 71st precinct, the Plaintiff was processed, placed in a dirty cell, and denied medical attention for several hours despite numerous requests. He was later taken to Kingsboro Hospital for treatment and then to Central Booking for additional scans and searches. Subsequently, he was moved to Brooklyn Hospital for muscle pain treatment. Upon discharge, the Plaintiff was informed that he would not see a judge, as his case was dismissed and all charges were dropped.
