Chow appeared to be tipsy, and she showed sexual interest in Plaintiff. There was no sexual contact between Plaintiff and defendant. On the same day, after the Plaintiff Moreno and his colleague Mata left her apartment, defendant Chow called the NYPD Internal Affairs Bureau to report her encounter with the Plaintiff. She did not allege any sexual contact with him. She was immediately interviewed by a second-grade detective who did not find her credible. The case was then reassigned to another detective. On December 9th, 2008, during an interview with the new detective Defendant Chow falsely alleged that she was raped by Plaintiff. Plaintiff was then falsely charged with Rape in First Degree, Burglary in Second Degree and Official Misconduct. As a result, he was arrested without any probable cause, despite Chow already being found not credible and no credible evidence (physical, scientific or otherwise) ever being found to support her allegations against the Plaintiff. Plaintiff was maliciously and selectively prosecuted solely because of his race (Hispanic), in order to allow the defendants to gain monetary benefits. The District Attorney Office had previously declined similar cases involving powerful Caucasian males. Additionally, the District Attorney, the District Attorney Office staff defendants and the NYPD  defendants, intentionally, presented limited evidence, violating Plaintiff’s “Brady” rights. On May 26th, 2011, the Plaintiff was found Not Guilty of rape and burglary. He was found guilty of three counts of official misconduct, due to a clear error of law by the court, jury confusion, and prosecutorial misconduct. As a result, the Defendants caused the Plaintiff to spend one year in jail in Rikers Island, lose his employment, and suffer damages to his financial interests, reputation, mental health, and incur significant legal expenses. On December 2, 2009, Chow maliciously filed a frivolous lawsuit alleging Plaintiff raped and sexually assaulted Chow. During the trial, District Attorney Cyrus Vance and District Attorney Staff Lisa Friel, Coleen Balbert, and Edward Taachi violated Plaintiff's constitutional rights by failing to turn over relevant materials. The District Attorney also misstated the law in his summation. On August 8, 2011, Plaintiff was sentenced to one year in jail for three counts of Official Misconduct.
