Plaintiff alleges that Kleidman, O'Leary and Maggio unlawfully used GPS, wire taps, and pen subpoena to locate and arrest plainitff at the plaintiff's private domicile and the arrest itself took place on March 7, 2017. During the arrest, Detectives O'Leary and Maggio broke down the front door, physically attacked plaintiff by hitting him and pinning him to the floor. Plaintiff was handcuffed and while on the floor, O'Leary and Maggio pressed their knees on the back of plaintiff's head, neck, and back for several minutes causing plaintiff to lose consciousness, the officers then searched the residence. Plaintiff also alleges that Kleidman, O'Leary, and Maggio worked together to falsify police reports to cover up the flagrant use of excessive force during the arrest.
