Four or five armed officers carrying assault style rifles and wearing tactical gear with bullet proof vests surrounded Plaintiff 1 in the apartment. Plaintiff 1 was partially undressed at the time the officers came into the apartment and was in the process of putting on his socks and shirt. The officers restrained Plaintiff 1, grabbed the sock from his hand and threw it aside, preventing him from putting it on his foot. The officers refused to permit Plaintiff 1 to put on a shirt, and placed separate handcuffs on each of his wrists. Plaintiff 2 pleaded with the officers to leave Plaintiff 1 alone, telling the officers that Plaintiff 1 had not done anything. Plaintiff 2 was then arrested. Plaintiff 1, handcuffed and still partially naked – in that he was still without any shirt, shoes or left sock – was dragged into the hallway while the officers searched his apartment without permission or a warrant. Plaintiff 1, still partially naked, was then dragged out of the building, into the freezing air and in front of the general public. Plaintiff 1 pleaded with the officers while he kept telling them he had not done anything wrong. PO turned and pushed Plaintiff 1’s face against a nearby police transport vehicle, injuring Plaintiff 1’s left hand, left shoulder, and back. Plaintiff 1 continued to plead with the officers saying he had not done anything wrong when one of the officers struck Plaintiff 1 in the mouth. Both Plaintiffs were taken to a police precinct where they were searched. While at the precinct, Plaintiff 1 requested and was denied medical attention. After several hours, the officers brought Plaintiff 1, bound and shackled at his feet and still partially naked, in the freezing rain to court. Plaintiffs were arraigned and charged with several crimes. Defendant POs Michelle Hanson, Larry Meyers, Eric Worohy, and Joseph Calabrese, were also present at the time of Plaintiff's arrest and ignored his complaints of severe pain. Plaintiff was handcuffed and transported to the 71st Precinct in Brooklyn. In the course of transport, Plaintiff continued to express pain and request medical attention for the injury to his left leg, but these complaints were ignored despite the visible disfiguration, bruising, and inflammation of the leg. Several hours passed before Plaintiff was brought upstairs for arraignment on July 5, 2014. At the time of his arraignment, a Court officer acknowledged the condition of his leg and inquired as to why there were no medical records in the Court's file. \n\nFollowing his release from Defendant's custody, Plaintiff went to the Emergency Department of Kingsbrook Jewish Medical Center to receive treatment for his left leg and ankle. William Gardner was a Captain in the NYPD who is also a named defendant and was present when the incident occurred. After the rally, the plaintiffs and others proceeded to the NYPD’s 73rd Precinct, where they lawfully gathered on the sidewalk in front of the building to protest the NYPD’s stop and frisk practices. Captain Gardner ordered the above-named defendant police officers to arrest the above-named plaintiffs. Plaintiffs were handcuffed and transported to the 75th precinct, held for several hours and made to return to court for various appearances.
