Plaintiff later sought medical treatment for physical and emotional injuries. Defendant Officers pulled up in their marked police vehicle and stopped next to a parked car near Plaintiff. Defendant Fitzgerald, while sitting in the front passenger seat of the marked police vehicle, extended his hand outside of the window and took a small object from an individual who was sitting in the driver's seat of the parked vehicle. Shortly after, the marked police vehicle backed up, allowing the parked vehicle to drive away. Then, Defendant Police Officer Scott Pariona lowered the front driver's side window and asked Plaintiff's what they were looking at. Plaintiff responded and Defendant Pariona got out of the vehicle and shoved Plaintiff Braimah. That is when Plaintiff Braimah informed Defendant Pariona he was recording. \n\nUpon walking away, an individual the Plaintiffs were with (michael Atkins) was  struck by Defendants Pariona and Fitzgerald, Plaintiffs pleaded them to stop. Fearing for Atkin's life, Plaintiff Dukuray climbed on the trunk of the car where Mr. Atkins was pinned and kicked Defendant Pariona in the head before running away. Then, Plaintiff Braimah struck Defendant Pariona in the back of the head once, and also ran away. Upon seeing the Officers, Plaintiff Dukuray stopped running and put his hands up in the air. Despite this, Defendants tackled Plaintiff Dukuray and struck him with closed fists multiple times in his head, torso, and buttocks. When Plaintiff Braimah exited the park, he encountered a Defendant Officer who had his gun pointed at Plaintiff Braimah. \n\nWhile at the precinct, Plaintiff Dukuray asked Defendant Officers numerous times to loosen the handcuffs because they were too tight and hurt his wrists. A police officer said to another officer that Defendant Braimah has a lawsuit, to which the officer responded someone has to teach him something. At which point, Plaintiff Braimah was thrown into a holding cell, and numerous Defendant Officers, including PO John Does 1-10, struck his head and body with closed fists, as well as kicked his head and body. The Plaintiff's mother, Plaintiff Conlon came outside and begged the Officers to stop when they violently pushed her back causing her to fracture her tailbone. \n\nSubsequently, Plaintiff Conlon was placed under arrest with excessively tight handcuffs despite her tailbone being fractured and was further subject to an unlawful search. Despite the injuries of both Plaintiffs they were transported unlawfully and without cause to the 40th Precinct. At the Precinct Plaintiff Conlon requested medical attention and she waited over an hour before being transported to hospital. Plaintiff Morales was released after being falsely detained for 8 hours. When he received treatment he was diagnosed with hematoma and sprain to the left wrist. While both Plaintiffs were helpless in custody the Officers initiated a malicious prosecution against both. The plaintiff had received permission from her stepfather to use his car to pick up food from a nearby restaurant. After legally parking and picking up the food, she returned to find she had locked the keys in the car. She called her boyfriend, Patrick Tillay, for help, and he, along with a friend, used a hanger to lower the window and retrieve the keys. Defendants approached and questioned their method of entry. Despite explaining the situation and offering documentation proving her stepfather’s ownership and her valid driver's license, the defendants, after spending 45 minutes examining the documentation, requested the plaintiff go to the precinct for questioning without verifying the documents. Defendants searched the plaintiff's bag, falsely claimed to find crack cocaine, and then destroyed the bag and its contents. The plaintiff was transported from the 40th precinct to Bronx Central Booking, where the defendants fabricated evidence and falsely accused her of drug possession. During her confinement, the plaintiff, who was pregnant, was denied food and sanitary water. At arraignment, she received an adjournment in contemplation of dismissal and had to pay $290 to retrieve the vehicle from the towing company. The plaintiff was in custody for 22.5 hours. Venterpool was legally near East 146 st. and 3rd ave. of Bronx when he was stopped, searched, grabbed, assaulted, battered and detained by the above officers without reasonable cause or a warrant. Venterpool was also subject to strip search and was falsely prosecuted for a crime he did not commit. Venterpool was then incarcerated for more than 24 hours without his consent and made multiple court appearances. The court appearances all resolved favorably for him.\nFrom this incident, Venterpool suffered from both emotional and physical pain. He suffered scorn, ridicule, embarrassment in both social and professional life as well as reputational harm in his community.
