As he exited plaintiff observed defendants P.O. Soto and P.O. Zabala in a marked police vehicle staring directly at him. As plaintiff began to drive away in his car, he heard a siren and saw that the defendant officers were signaling for him to pull over. Plaintiff pulled over and the officers approached. Officer Soto asked for plaintiff's license and registration, and then asked him to leave the car and do a breathalyzer test, to which plaintiff consented. The machine read below the legal blood alcohol limit. Officer Soto insisted plaintiff wasn't blowing properly, and repeatedly made him blow again, and each test read below the legal limit. Despite no reading of a blood/alcohol level over the legal limit, defendant P.O. Soto then placed plaintiff in handcuffs, put him in the backseat of the marked police vehicle and transported him to the 33rd precinct of the NYPD. Plaintiff remained at the precinct for about 7 hours before being transferred to central booking. \n\nPlaintiff was charged with driving under the influence. In a sworn criminal complaint, defendant Officer Soto falsely stated that he saw Plaintiff driving under the influence and that plaintiff refused a breathalyzer test. Plaintiff was released from central booking after 38 hours of detention.
