As the plaintiffs went to open the door, the defendants bust through and broke the door with shields, guns and rifles. Plaintiffs were instructed to get on the floor and handcuffed. The handcuffs were placed so tight that the plaintiffs’ wrists turned red. Assault and multiple batteries were committed against the plaintiffs. Shortly thereafter, more officers came to the apartment. The defendants executed a search of the apartment without showing a search warrant. The plaintiffs were told they were being taken into custody for being in criminal possession of controlled substances. Consequently, the defendants took the plaintiffs into custody to a police station in the County of Bronx and there charged them with crimes. The plaintiffs were thereafter held in custody for about 36 hours until released. On or about July 14, 2016, the charge was dismissed.\nIn particular, Defendant P.O. Robert Thomas was the arresting officer, and he, along with Defendant his supervising sergeant, unlawfully determined that the plaintiffs were in criminal possession of contraband. Defendant P.O. Robert Hoey provided false statements based on his observations in the apartment, leading to the plaintiffs’ false arrested and maliciously prosecuted.
