They had a warrant based on a tip from a confidential informant that crack cocaine had been sold by Ms. McClain's brother in the apartment. Ms. McClain's brother did not live in the apartment, nor did he ever live there or have keys, and only visited every few weeks. Ms. McClain, wearing only undergarments at the time, was pushed into a chair and handcuffed with excessive tightness. Her mother and six-year-old son were in another part of the apartment, told to \"get the fuck down on the floor\" at gunpoint, and Ms. McClain was not allowed to see them. Their requests to use the bathroom were denied. The apartment was ransacked and property damaged. After about a half hour, Ms. McClain requested proper clothing; and despite her wishes for her mother to assist in putting them on, a male officer dressed her. Her requests to loosen the handcuffs were ignored, causing swelling the day after. Ms. McClain was brought to the precinct against her will, and her mother and son were told to vacate the apartment for them to search it further. When they returned the door was off its hinges and the apartment left completely unsecured for anyone to enter. At the precinct, Ms. McClain was searched by a female officer in an obtrusive manner. She was held in a cell in the precinct the entire day and transferred to Booking overnight where she was held overnight until arraignment. \n\nOfficer Demchenko was the deponent of the criminal complaint against Ms. McClain which falsely alleged that the officers found drugs in the apartment and that Ms. McClain had admitted to smoking weed. Officer Allen falsely averred in an Affidavit of Inventory of Property Taken that various narcotics in NYPD custody were recovered via the search.
