Plaintiff assisted in freeing the dog but Defendant Simmonds was intoxicated, the smell of alcohol was prevalent on his breath, and became enraged with Plaintiff. Defendant Simmonds then put his hand on his gun and trapped Plaintiff against a window and began choking him. Defendant Officers Javier Colon, Cesia Herrera, and Navdeep Kamboj arrived and pulled Defendant Simmonds off Plaintiff. Defendant Officers Shahzad Hussain, Ryan Lambert, Mindaugas Maleckas, Michael McManus, Orest Petrychyn, Amador Rivera, Michael Rossides, Sean Sheehan, and Defendant Seargent Nicholas Loweth arrived. Defendant Simmonds informed officers that Plaintiff and others ganged up on him and tried to \"swing at him\" and that's why he was assaulting Plaintiff. Witnesses told Defendant Officers that it was Defendant Simmonds being confrontational. Defendant Colon told Defendant Simmonds he wanted to keep Defendant Simmonds out of trouble. Since Defendant Simmonds was clearly intoxicated, the other Defendants gave Defendant Simmonds a bottle of water and allowed him to keep his gun. Defendant Lambert then reviewed security footage, said there was nothing on the camera, and Defendants arrested Plaintiff. The criminal complaint filed against Plaintiff was on entirely false statements and Defendant Simmonds manufactured false words that he claimed Plaintiff threatened him with.
