As plaintiff left the restaurant to return home with the food, he was bum-rushed by defendant officers who forcibly grabbed, slammed to the ground and physically assaulted him. Defendant officers grabbed the food plaintiff had just bought and threw it away and damaged his cell phone. Plaintiff was tightly handcuffed with his hands behind his back, and further subjected to a strip search. When plaintiff inquired as to the reason for his arrest, he was informed that he fit the description of a liquor store robbery suspect. Plaintiff was then transported to a nearby liquor store, where defendant officers reviewed the store’s surveillance tape which confirmed plaintiff did not commit any robbery or any other crime. Plaintiff was transported to the 70th Precinct and detained for a lengthy period of time. Plaintiff was transported to the Central Booking for arraignment. While plaintiff awaited arraignment, defendant officers met with prosecutors from the Kings County DA’s Office, and falsely stated that plaintiff committed the charged crimes. Based on their false testimony, prosecutors initiated actions against plaintiff. Eventually, prosecutors determined there was no evidence of any crimes committed by plaintiff and declined to prosecute. After detaining plaintiff for a lengthy period of time, plaintiff was summarily released from his unlawful detention.  Plaintiff however was issued a summons concerning a prior January 29, 2013 arrest, which required him to appear at criminal court to defend false charges levied against him.
