Despite finding no contraband, the plaintiff was arrested and detained for 10 hours, after which a criminal case was initiated based on fabricated evidence, including drugs allegedly found in the apartment. The plaintiff was charged with criminal possession of a controlled substance, though Officer Peralta and the other officers knew the charge was false. The case led to court appearances and eviction proceedings. The criminal charges were dismissed on February 13, 2020. However, most of the confiscated cash has not been returned, with only $2,409 vouchered.
