Before the train stopped, the plaintiff had not been involved in any altercations or violated any laws. The defendants entered the train and ordered the plaintiff to get off without cause. When the plaintiff inquired why, the defendants forcibly grabbed him and his wheelchair, lifting it improperly and breaking the left footrest, causing the plaintiff's left leg to dangle and be twisted painfully. Despite the plaintiff's screams, the defendants dragged him and his wheelchair up the station stairs to the street. The plaintiff informed the defendants of his intent to file a complaint, after which they decided to escort him back to the train instead of seeking medical assistance. The plaintiff traveled home in severe pain. At no time did the plaintiff resist. Greco entered the Plaintiff’s room at a rehabilitation and nursing center, assaulted and battered the Plaintiff, and arrested him. The Plaintiff is a quadriplegic and relies on assistance from nurses at the center to do basic tasks, including help with setting up utensils so he can properly eat. On the day of the incident, Plaintiff was about to eat lunch but did not see any nurses around to help. He went to the break room and knocked on the door to request help. The nurses refused to help him and called the police because he was too demanding. The Defendant responded to the call by entering the Plaintiff’s room and threatening to arrest him without cause. The Plaintiff requested that the Defendant leave him alone unless he was planning on helping Plaintiff with the utensils. In response, the Defendant placed the Plaintiff in a headlock, twisted his arm behind his back, choked him, and forcibly handcuffed him. As a result of Defendant’s actions, the Plaintiff developed nerve damage in his wrists, and suffered from body aches and pain and soreness to his neck, throat, back, body, elbow, shoulder, wrists, and arms. \n\nThe Plaintiff was unlawfully transported to the police station, where he was held for two to three hours. The Defendant initiated unlawful criminal proceedings against the Plaintiff by creating and withholding false evidence and by filing false police reports and summonses. The Defendant falsely accused the Plaintiff of disorderly conduct, claiming he used obsence language. However, even if the Plaintiff had used such language, it does not constitute a crime and does not meet the criteria for a disorderly conduct charge. All charges against the Plaintiff were ultimately dismissed.
