Plaintiff was visiting Brooklyn to see a friend; he had biked to his destination and had a plastic bag of takeout food with him. Police patted the plaintiff down; upon being asked why, said they had received a call from a woman who said she saw a man with a gun on a bike. Plaintiff asked if he had specifically been identified or his bike, and the officers said no. Two additional, unidentified officers arrived at the scene, went inside a nearby building and emerged with a wrapped plastic bag that had the shape of a gun. Jean-Baptiste and Adiniou then handcuffed the plaintiff.  The officers then drove the plaintiff around for a couple of hours before taking him the the precinct, and ultimately recorded an arrest time that was several hours after they took him into custody.\n\tPolice paperwork, signed off on by Lieutenant Ortlieb, showed that the gun attributed to the plaintiff was seized days before plaintiff’s arrest. Ortlieb did not inquire into this inconsistency. Inspector Lehr also signed off on paperwork that reflected inconsistencies he did not inquire into. \n\tJean-Baptiste initially told prosecutors that he had seen the plaintiff bike past him while Jean-Baptiste was driving on patrol, and in that moment identified a gun in a plastic bag as well as food. He later testified at grand jury proceedings that he first encountered the plaintiff sitting on his bike, and that he had seen the gun between takeout containers in the plastic bag; then, he instead testified the gun was already out of the bag. A year later at the suppression hearing, Jean Baptiste had no memory of previous testimony that the gun was out of the bag, denied testifying to that effect, and instead testified that he had approached the plaintiff  based on a tip from a reliable and confidential informant. \n\tThough the case was ultimately dropped, the plaintiff spent a year at Rikers Island. A New York Times report later exposed a gun-planting scheme Jean-Baptise, Adiniou, and others at the 67th precinct were involved with.
