This arrest came subsequent to an investigation of alleged illegality that did not involve Plaintiff. During the arrest, Kolody handcuffed Plaintiff, beat him physically, and detained him against his will. Plaintiff was charged with Obstructing Governmental Administration in the 2nd Degree, in violation of New York State Penal Law § 195.05, as well as Resisting Arrest, in violation of Penal Law § 205.30. Plaintiff was compelled to remain incarcerated for approximately eighteen hours until his release from jail on September 9, 2013. During this detention, Plaintiff was strip searched and denied access to medical care. The criminal charges against him were dismissed on October 22, 2013.
