Officer Pom Seda and Sgt. Althaibani arrived with other officers and Seda immediately accosted plaintiff, without knowing whether or not he was involved in the dispute. Seda then began to search plaintiff and then arrested and handcuffed him. He was then questioned about an alleged weapon that was found at the scene. Plaintiff informed them he was not involved in the dispute and was not in possession of any weapon. They still subjected him to a strip search and charged him with criminal possession of a weapon. Mr. Tremell verbally protested his cousin's treatment. The officers then placed Mr. Tremell in handcuffs. While handcuffed, one of the officers sprayed pepper spray into Mr. Tremell's eyes. Mr. Tremell did not commit any crime and the officers had no probable cause to arrest him.\n\nMr. Tremell was taken to a nearby police precinct. The officers filed false police reports claiming that Mr. Tremell was gathered with 29 others on a sidewalk, refused to leave and bumped Police Officer Alexander Seda. The reports were forwarded them to the prosecutors at the Kings County District Attorney's Office. Mr. Tremell was charged with Obstructing Governmental Administration in the Second Degree and Disorderly Conduct. Mr. Tremell spent 50 hours in custody.
