Description: On 6/21/19, at approximately 9:30 p.m., Plaintiff Joshua Mendez was stopped, searched, grabbed, assaulted, battered, and detained in an aggressive and excessive manner all absent an arrest warrant, probable cause, or reasonable cause in the vicinity of 1501 Undercliff Avenue in the Bronx. Police Officer Ely Gonzalez (Shield No. 25462), Police officer John Doe, and Police Officer John Roe had reason to know that they lacked legal justification for these actions. Plaintiff claims that the illegal stop and seizure were based solely on his age and/or race as part of the city's custom and practice of racial profiling and reaching arrest and summons quotas. The case was eventually terminated in Plaintiff's favor.
