Complaint
Description: On October 10, 2018, Plaintiffs Christina Rosas, Joshua Rosas, and Elyse Torres were buying breakfast when Police Officer Gregory Smith and two unnamed officers approached the Plaintiffs and harassed them without any legal basis. The police officers escalated the situation and assaulted and battered the Plaintiffs. The Plaintiffs were arrested, detained, and searched them at the precinct. All three were maliciously prosecuted. The District Attorney declined to prosecute Plaintiff Joshua Rosas due to a lack of probable cause. Plaintiff Elyse Torres had all proceedings dismissed against her in her favor on April 19, 2019. The charges against Christina Rosas were dismissed by a judge on July 5, 2019.
