Description: Plaintiff was crossing the street to catch his bus when a police car almost hit struck him twice. Defendant Officer Santos exited the car, asked Plaintiff is he was going to pick up a piece of foil that had fallen from his pack of cigarettes, and asked for ID. More officers arrived on the scene and aggressively forced Plaintiff on the ground, tightly handcuffed him, and searched him causing his paints to fall down. Plaintiff was taken to the 52nd Precinct and charged with Resisting Arrest, Littering, and Assault, which were ACD'd.
