Description: On February 24, 2014, the plaintiff, Mondaray Whitaker, was walking back from a grocery store with his dog on a leash. As he approached his building complex, a car cut him off. Three police officers in plain clothes exited the car and surrounded Mr. Whitaker. They did not identify themselves as police officers. The officers asked Mr. Whitaker where he was coming from and if he was carrying any weapons. He told them where he was coming from and that he was not carrying weapons. One of the officers then took Mr. Whitaker's dog up this apartment. Mr. Whitaker asked the remaining two officers why he was being detained, but they did not answer him. Description: On February 3, 2014, plaintiff lawfully entered a train station. Defendant officers approached the plaintiff, accusing him of entering through an exit gate. Officers handcuffed his arms tightly behind his back. Plaintiff was brought to a precinct where he was held for approximately 24 hours. A judicial officer ordered plaintiff released. Defendant officers filled out false/misleading reports and forwarded them to prosecutors at the DA's office. Plaintiff was charged, and after 4 court appearances, the proceedings were adjourned in contemplation of dismissal.
