Description: On February 16, 2012, plaintiffs Rudolph Riley and Michael Baptiste were walking. Plaintiffs along with other individuals were grabbed by defendant officers, John Borruso, Robert Flynn, Matthew Ficano, and others, and taken to the precinct. Plaintiffs were charged and taken to booking; plaintiffs committed no crime. After two days in custody, plaintiffs were arraigned and released. All charges were dismissed.

Description: On January 28, 2012, Defendant NYPD officers Jane D'Amico and Jon Barusso arrested Plaintiff on the false claim that he violated a Temporary Order of Protection. After the officers placed Plaintiff in jail, he began to feel significant chest pains. The officers refused to provide treatment to Plaintiff. When the officers finally agreed to call an EMS, they demanded Plaintiff be treated in his cell. Plaintiff, handcuffed, was eventually ambulanced to a hospital, where his heart condition was treated. Plaintiff was then returned to the precinct. He was then advised that no charges were being brought against him and that he was free to leave.

Description: On February 16, 2012, at approximately 4:30 P.M., Plaintiff was with acquaintances outside when he was approached by police officers and stopped without reasonable suspicion. The police officers told him that there was a robbery in the area, and he was placed under arrest without probable cause. At the time of Plaintiff’s arrest, the police officers conducted assault and battery against Plaintiff. Plaintiff was deprived of his personal property.
