Description: On May 27, 2011, the two Plaintiffs were lawfully present in the backyard of a private residence when POs Thomas McDonnell and Trebor Evans, and other NYPD officers, entered the backyard, seized and arrested the two Plaintiffs; all without legal basis. Plaintiffs were not engaged in any unlawful or suspicious activity at the time of the officers' arrival. The Plaintiffs were searched again at the precinct. Neither search yielded any evidence of guns, drugs, or contraband. While Plaintiffs were unlawfully imprisoned, the officers completed arrest paperwork which, upon information and belief, alleged that the Plaintiffs were observed smoking marijuana, by officer McDonnell.
