Description: On December 16, 2010, while Plaintiff was walking on the street, numerous uniformed NYPD officers, Defendants P.O. Jermaine Johnson, P.O. Uriel Henry, CPT. Joseph Memoly and SGT. Victor Torres approached Plaintiff. The officers immediately began searching Plaintiff through his pockets and waistband. While Plaintiff was being searched, the police saw another man who watched what was happening and then began to run away from the police and Plaintiff. When this happened, the four Defendants immediately threw Plaintiff onto the concrete, and Defendant Torres stomped on his hand. Plaintiff was then handcuffed and placed under arrest. Plaintiff had no connection with the other person.

Description: Plaintiff was approached and asked to provide his identification on the Coney Island Boardwalk. When plaintiff asked why, Officers arrested him. Defendants then knocked him to the ground, assaulted and battered plaintiff including striking him with closed fists, batons, kicking him and ripping off plaintiff's shirt. A defendant officer stuck his knee into plaintiff's neck as plaintiff lay helpless on the ground. Plaintiff taken to 60th precinct, then hospital where he underwent treatment including multiple blood transfusions as a result of the beating he sustained at the hands of defendants. Charged with disorderly conduct and resisting arrest, which were later ACD'd.
