Description: On February 22, 2012, at approximately 2:30 p.m., plaintiff was arrested without cause from his home by defendant officers, including Detective John Burchette, and charged with identity theft, among other offenses. Plaintiff was tightly handcuffed, forcibly pushed into a police car, and transported to the 72nd Precinct, and eventually taken to Central Booking. The defendant officers met with prosecutors and falsely stated that Plaintiff had assumed someone else's identity, leading to his prosecution. Plaintiff could not make bail, and was subsequently incarcerated at Rikers Island for several months until the charges were dismissed on September 4, 2012.
