Description: Plaintiff was walking home after buying some beer when defendant officers stopped him, asked for ID, and gave him a summons for an Open Container even though the alcohol was sealed. Officers then pushed him, arrested him, brought him to the 75th Precinct, and charged him with Harassment and Resisting Arrest. The charges and summons were all dismissed.
